Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the NordicVM website and the services offered by NordicVM ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
1. Agreement to Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service. This Agreement shall be effective for the whole duration of your account.
2. Service Provision
We agree to provide to you the services as described on our website, including but not limited to Dedicated Servers, Virtual Private Servers (VPS), and LIR Services, subject to the terms and conditions of this Agreement. We strive to maintain a 99.99% network and power uptime. This Service Level Agreement (SLA) does not cover downtime caused by user error, software-related issues, or scheduled maintenance.
3. User Accounts and Responsibilities
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You are solely responsible for all content, data, and applications you host on our services. You must ensure that you have all necessary rights and licenses for the content you host.
4. Acceptable Use Policy (AUP)
You agree not to use the Service for any illegal or prohibited activities. Prohibited activities include, but are not limited to:
- Illegal Content: Hosting, distributing, or linking to any content that is in violation of the laws of Norway or your local jurisdiction. This includes copyrighted material for which you do not hold the rights.
- Spam / Unsolicited Email: Sending unsolicited bulk or commercial messages over the Internet.
- Network Abuse: Any activity that interferes with the services of another user or network, including denial-of-service (DoS) attacks, network scanning, or port scanning.
- Security Violations: Attempting to gain unauthorized access to any computer, network, or account. This includes hosting malware, phishing sites, or botnet command-and-control servers.
- Resource Abuse: Using an excessive amount of server resources (CPU, RAM, I/O) that results in a negative impact on other customers. This applies primarily to shared VPS environments.
Violation of our AUP may result in immediate suspension or termination of your services without a refund.
5. Payments, Billing, and Renewal
You agree to pay for the services you select in advance of the time period during which such services are provided. All services are set to automatically renew for the same billing cycle unless a cancellation request is submitted. It is your responsibility to ensure that your payment information is current. If we are unable to process a payment, your service may be suspended. A late fee may be applied to overdue invoices. Services suspended for non-payment may be terminated and all data erased after a period of 7 days.
6. Cancellations and Refunds
You may cancel your service at any time by submitting a cancellation request through our client area. Cancellation requests must be submitted at least 7 days before the next billing date. Due to the nature of our services, refunds are provided on a case-by-case basis and are not guaranteed. Generally, dedicated servers and LIR service setup fees are non-refundable. VPS services may be eligible for a pro-rated refund for unused time, at our sole discretion.
7. Limitation of Liability
In no event shall NordicVM, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
8. Indemnification
You agree to defend, indemnify and hold harmless NordicVM and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
9. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. You agree that any legal action or proceeding between you and NordicVM shall be brought exclusively in a court of competent jurisdiction sitting in Tromsø, Norway.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
